Welcome to Diamonds of Deal Ltd (“we,” “our,” or “us”). These Terms and Conditions govern your use of our website and services. By accessing or using our website, you agree to be bound by these terms. If you do not agree, please refrain from using our services.

1. General Terms

1.1 These terms apply to all purchases, services, and interactions with our website and company.

1.2 We reserve the right to modify these terms at any time. The updated terms will be posted on our website.

1.3 Your continued use of our website and services constitutes acceptance of any revised terms.

2. Products and Pricing

2.1 All diamonds and jewellery products are subject to availability.

2.2 We strive to ensure product descriptions and pricing are accurate. However, errors may occur, and we reserve the right to correct them.

2.3 Prices are in GBP (£) and include VAT unless stated otherwise.

2.4 We may change product prices without prior notice.

3. Orders and Payment

3.1 Placing an order constitutes an offer to purchase, which we may accept or decline at our discretion.

3.2 Full payment is required before dispatch of any product.

3.3 We accept payments via all major credit/debit cards and bank transfers.

3.4 If a payment is declined or flagged as fraudulent, we reserve the right to cancel the order.

4. Delivery and Returns

4.1 We aim to deliver orders within the estimated timeframe. However, delays may occur beyond our control.

4.2 Risk and ownership of goods pass to the customer upon delivery.

4.3 Customers may return eligible products within 14 days in accordance with our Returns Policy.

4.4 Bespoke or customised jewellery is non-refundable unless defective.

4.5 You will receive a notification when your goods have been dispatched. You must inform us as soon as possible, and in any event no later than within 72 hours if you have not received your goods within 48 hours of first receiving the Dispatch Notification. To inform us that your goods have not been delivered, please contact us.

4.6 Should a direct delivery not be possible due to a lack of acceptance, you are obliged to collect the goods within 5 working days of receiving notification from our delivery service that the goods are ready for collection. After the expiration of the period of 5 working days, the goods are considered rejected. In such cases, you will be reimbursed for the cost of the goods, minus the cost of delivery, if paid by you, and minus the costs charged to us by the respective shipping company for returning the goods to us. (If the goods are custom-made, we reserve the right to only reimburse the costs for the item(s) itself, but not the costs that arise as a result of the individualisation of the item(s)).

4.7 To protect against theft, we recommend that you provide a delivery address that is not accessible to third parties.

5. Warranties and Guarantees

5.1 Not all diamonds will have certification from gemmological laboratories, but those that do will be certified by GIA or IGI.

5.2 We provide a one-year warranty covering manufacturing defects in material or workmanship.

5.3 Normal wear and tear, accidental damage, or misuse are not covered under warranty.

5.4 In the unlikely event that the goods delivered prove to be faulty, damaged, or different from what you ordered, Diamonds of Deal will offer to replace or repair the goods or, if you prefer, refund the purchase price for the return of the defective goods. Under the Consumer Rights Act 2015, a customer has a short-term right to reject goods that are of unsatisfactory quality, unfit for purpose or as not described to get a full refund. The right is limited to 30 days from the date the customer took ownership of the goods. This warranty becomes effective in addition to your statutory warranty claims, which are not affected by this. If you want to make a warranty claim, please contact us.

5.5 If defective goods are returned, regardless of the legal basis for the return, the respective goods must be returned in full. If the goods are in additional packaging within the outer packaging (shipping box) when delivered, e.g. in special additional protective packaging, gift packaging, a ring box or a jewellery box, this packaging is considered a part of the delivered goods and must be returned to us as well when the jewellery is returned.

5.6 In order to enforce the warranty, the goods must be returned in full, meaning with any special, additional packaging (except the original shipping box) and the certificate that may have been sent with the goods. In addition, proof of purchase must be presented by the buyer. Should the certificate not be sent alongside the goods, we may charge £335 plus VAT for a replacement certificate. You have the right to provide evidence that we have not incurred any damage or damage for the replacement certificate that is considerably lower than the aforementioned lump sum.

5.7 In the event of an insufficient delivery, costs for special or additional packaging and other supplementary material may be charged. The cost of returning the goods to us and insuring them during transport shall be borne by you.

5.8 Should the goods show signs of damage, scratches or deterioration, we are permitted to require demand compensation from you to account for the diminishment in their value. We reserve the right to offset this compensation against any repayments to you. In this case, our repayment to you can be reduced accordingly.

5.9 For safety reasons, we recommend that you do not put the name Diamonds of Deal on the packaging of your return, as it contains the term “Diamonds” and may increase the risk of your package being stolen or opened in transit. To arrange the return of defective goods, please contact us and we will provide you with further instructions. 5.10 Diamonds of Deal goods have a one-year guarantee against manufacturing and processing defects. This warranty does not apply to goods that are exposed to wear and tear, misuse or damage to property, regardless of the causes. The item(s) must not be damaged by improper handling or improper external impacts (e.g. knocks, dents, or pressure) and must not be changed, manipulated, repaired or serviced by a service provider other than Diamonds of Deal. Wear and tear caused by the intended use of the piece of jewellery does not constitute manufacturing defects and is not covered by the warranty. If the purchased jewellery has been tampered with or changed in any way by you, another jeweller or any other third party, the guarantee becomes void.

6. Limitation of Liability

6.1 We are not liable for indirect, consequential, or incidental damages arising from the use of our products or services.

6.2 Our liability for any claim shall not exceed the purchase price of the product.

7. Intellectual Property

7.1 All website content, including images and text, is owned by or licensed to us and may not be reproduced without permission.

8. Privacy Policy

8.1 Our use of personal data is governed by our Privacy Policy, available [here/link].

9. Right of Withdrawal

9.1 You have the right to withdraw from the use of our website and services at any time without providing a reason. If you have created an account with us, you may request its deletion by contacting us at info@diamondsofdeal.co.uk.

9.2 If you have subscribed to any of our digital services, newsletters, or marketing communications, you may withdraw your consent at any time by using the "unsubscribe" link in our emails or by contacting us directly.

9.3 Any withdrawal from the website or our services does not affect any prior transactions or obligations you may have under separate agreements, such as purchases made through our platform.

9.4 We reserve the right to suspend or terminate access to our website or services if misuse, fraudulent activity, or violations of our Terms and Conditions are detected.

10. Governing Law

9.1 These terms are governed by and construed in accordance with the laws of England and Wales.

9.2 Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
